03 / LEGAL update
Nakivubo Channel Case Update (Greenwatch & Ors v. Attorney General & Ors)
Greenwatch, The Environment Shield, Centre for Constitutional Governance, and the Centre for Public Interest Law (CEPIL) jointly filed a public interest environmental rights application in the High Court of Uganda (Civil Division) challenging a presidential directive and subsequent administrative approvals that purport to authorize a private developer, Kiham Enterprises (U) Ltd, to redevelop, cover, and construct commercial structures over the Nakivubo Channel in Kampala. The case raises fundamental questions about the constitutional limits of executive authority in relation to natural resources held in trust for the people of Uganda, and the justiciability of the right to a clean and healthy environment under Article 39 of the Constitution of the Republic of Uganda, 1995 as amended.
